These Terms of Service ("Terms") govern your access to and use of the websites, mobile and web applications, and services provided by Vyve Care ("Vyve", "we", "us", or "our") (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be at least the minimum age required in your country to use account features of the Services. If you are under the age of majority where you live, you should review these Terms with a parent or guardian. By using the Services you represent that you meet these requirements.

Not medical advice

The Services, including any predictions, insights, articles, and tools, are provided for general informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. Vyve is not a medical device and is not a substitute for professional medical care. Cycle and fertility predictions are estimates and should not be relied upon as a method of contraception or as a guarantee of fertility. Always seek the advice of a qualified healthcare provider with any questions about a medical condition, and never disregard professional advice because of something you read or saw in the Services. In an emergency, contact your local emergency services.

Acceptable use

You agree not to misuse the Services. In particular, you agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Services or related systems; (c) interfere with or disrupt the Services; (d) reverse engineer or attempt to extract source code except as permitted by law; or (e) copy, scrape, or republish our content without permission.

Accounts

Some features may allow or require an account. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Many core features are designed to work without an account.

Intellectual property

The Services, including all content, software, text, graphics, logos, and the "Vyve" and "Vyve Care" names and marks, are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to these Terms. The health and cycle data you create remains yours.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or accurate, including the accuracy of any predictions or estimates.

Limitation of liability

To the maximum extent permitted by law, Vyve and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.

Changes

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
